A sigh of relief: Court Stay Order on AICTE mandatory e-journals
Education Promotion Society of India (EPSI) has got a sigh of relief
from Hon’ble Delhi High Court on the AICTE mandated e-journals issue
on this Friday hearing.
Mandatory journals prescribed by AICTE to All Technical Institutions
viz. Engineering Colleges, Management Institutes, Architect
Institutes, Pharmacy, MCA institutions etc. to whom AICTE prescribed
mandatory e- journals, must have a relief knowing that the Hon’ble
High Court of Delhi has stayed the AICTE’s notification on January 6,
2012 to compulsorily subscribe to some mandatory online journals. The
Hon’ble High Court of Delhi has issued an Interim Order stating that
the AICTE Order under Approval Handbook for 2012-13 will remain stayed
till January 31, 2012, when court will hear this matter again.
“This is a big relief by the Hon'ble High Court of Delhi. This
arbitrary decision of the AICTE would have created extraordinary
financial burden on technical institutions”, said Dr. H Chaturvedi,
Director, BIMTECH & alternate President, EPSI.
The main petition being raised is that the all AICTE approved
institutions have the fundamental right to buy anything as per their
requirement & choice as current requirement is completely opposite
from last year when subscribing to e-Journals was optional while print
journals were mandatory. Moreover, they imposed the list of journals
from foreign companies whose cost for most mandatory e-journals is
high as they are of foreign origin and are billed in US dollars.
Further, AICTE has made it clear in its new corrigendum (Updated on
AICTE website) that the institutions subscribing for the INDEST /
DELNET consortium approved may not require to subscribe e- journal for
the current academic year.
The final hearing on this matter will now be held on January 31, 2012.
